Terms of Service

These Terms of Service ("Terms") govern your access to and use of Masked Proxies ("Masked Proxies", "we", "us", or "our"), a service operated by Paragon Peak LLC. By creating an account, purchasing services, or accessing the platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, purchasing services, or otherwise accessing or using the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Cookies Policy, and our Refund Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Accounts & Security

You are responsible for safeguarding your account credentials, maintaining the security of your account, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or suspected breach.

We reserve the right, in our sole discretion, to suspend or terminate accounts for abuse, fraud, chargebacks, violations of these Terms or our Acceptable Use Policy, or any conduct we deem a security or operational risk.

4. Services

Masked Proxies provides residential proxy services, bandwidth purchases, proxy management tools, dashboard access, and related services. We may modify, expand, restrict, suspend, or discontinue any aspect of the Service at any time, with or without notice.

5. Acceptable Use

You agree not to use the Service, directly or indirectly, for any of the following:

  • Fraud, phishing, or social engineering
  • Distribution of malware, viruses, or malicious code
  • Credential stuffing or account takeover attacks
  • Spam or unsolicited bulk communications
  • Unauthorized access to systems, networks, or accounts
  • Denial-of-service (DoS or DDoS) attacks
  • Illegal scraping or scraping in violation of applicable law
  • Child sexual abuse material (CSAM) of any kind
  • Harassment, threats, stalking, or hateful conduct
  • Infringement of intellectual property or proprietary rights
  • Circumvention of laws, regulations, or sanctions
  • Any other unlawful or fraudulent activity

Violations may result in immediate suspension or termination of your account without refund and may be reported to law enforcement.

6. User Responsibility

You are solely responsible for your activity, requests, traffic, and compliance with all applicable laws and third-party terms. Masked Proxies does not monitor, inspect, review, or control customer traffic and is not responsible for the content or destination of any traffic sent through the network.

7. Bandwidth

Bandwidth is a digital consumable product. Usage is deducted as traffic is consumed. Bandwidth does not expire unless explicitly stated at the time of purchase. Purchased bandwidth is non-transferable between accounts.

8. Payments

Payments are processed through Stripe. Prices are listed in U.S. Dollars and may change at any time without notice. You are responsible for any applicable taxes, duties, or levies. Failed or disputed payments may result in immediate service interruption.

9. Refunds

All refund decisions are governed by our Refund Policy.

10. Service Availability

The Service is provided on a best-effort basis. We do not guarantee continuous uptime, specific success rates, the availability of any particular IP address, or the availability of any specific region or geographic location. Maintenance windows, outages, upstream provider changes, and network issues may occur from time to time.

11. Intellectual Property

All branding, software, dashboards, logos, trademarks, designs, and content associated with the Service remain the exclusive property of Paragon Peak LLC. No license or right is granted to you except as expressly stated in these Terms.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARAGON PEAK LLC SHALL NOT BE LIABLE FOR ANY LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, ACCOUNT BANS OR RESTRICTIONS ON THIRD-PARTY PLATFORMS, DATA LOSS, OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless Paragon Peak LLC, its owners, officers, directors, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service or your violation of these Terms.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason. You may close your account at any time from your dashboard. Upon termination, your right to use the Service immediately ceases.

16. Force Majeure

We are not responsible for failures or delays caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, internet or telecommunications outages, or upstream provider failures.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-laws principles.

18. Arbitration

Any dispute, claim, or controversy arising out of or related to these Terms or the Service shall be resolved exclusively through final and binding arbitration administered in the State of Florida, rather than in court, except that you may assert claims in small-claims court if your claims qualify.

19. Class Action Waiver

You agree that disputes will be resolved only on an individual basis and waive any right to participate in a class action, class arbitration, or any other representative proceeding.

20. Changes to These Terms

We may modify these Terms at any time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
